How to Deal with Your Landlord When Rent is Overdue BADLY

User-Submitted ArticleIf you are like me you aren't just surviving in these economic times, you are beyond living paycheck to paycheck. Here is some tips on how to deal with your landlord if you are behind in the rent.Difficulty: EasyInstructionsThings You'll Need:Guts, integrity, a plan on how you will be able to pay the back rent.11. Scary but true, call your landlord. It is better to call, and let him/her know what is going on before they start proceedings on you. Call even if they already have started proceedings.22. Know your rights and what will happen: it will take your landlord at least six months to get an eviction on you - in the meantime the court will ask (if you end up there) for some form of good faith * If you have a settlement or disability coming to you, show your landlord, be open and honest.* All these things can help to save you from eviction in the long run.* It is more costly for the landlord in the end to oust you then to work it out.* Last, the landlord CANNOT take all your stuff and put it out on the street. Only the Marshall can do that AFTER an eviction notice is finally signed by a judge. That again, takes months33. Judges tend to side always with the tenants. That's a good thing.44. Be honest with your landlord and the judge. Explain the economic situation and the desire to pay. Perhaps a payment schedule more workable can be made. The judge is going to want to know what your plan is to pay the back rent. Don't write bogus checks to buy time. Be honest and earnest. If you are never going to be able to pay the back rent or the current rent tell the judge. At least you will have time to find new digs.55. Be prepared to show your bank statements, income, etc. to the judge. If you have a settlement coming or disability make sure you have that information so the judge can have copies.66. Remember you will get through this, you won't be homeless in one hour. Just be honest and available at all times so that you can work thru this.
